• If I’ve Been Arrested, Can I Get TSA Pre Check / Global Entry?

If you have been previously arrested, but not convicted, does that disqualify you from receiving Global Entry / TSA PreCheck?

Basically can you get TSA PreCheck with a DUI?

I was arrested in college on some DUI alcohol charges, but all felony charges were eventually dismissed and dropped to a misdemeanor.

I have a credit card that comes free TSA Pre Check, but didn’t want to waste it if I will be denied if I can’t get Global Entry with DUI charge.

If you haven’t been convicted then you should be fine.

Just make sure you tell the truth on the application.

Also the Global Entry credit is free with the credit card, so doesn’t matter anyways.

The disqualifier for Global Entry is, “Have been convicted of any criminal offense or have pending criminal charges or outstanding warrants (to include driving under the influence).”

And for TSA Pre Check it says, “An applicant will be disqualified if he or she was convicted, pled guilty (including ‘no contest’), or found not guilty by reason of insanity for any of the following felonies regardless of when they occurred.”

So it sounds like you shouldn’t have a problem if there were dismissed charges.

However, be aware that these agencies also have discretion, so if there is some way for them to find it, they could choose to deny the application.

I’m not sure if they would, but it isn’t impossible.

And a thing to consider – I’m pretty sure if you are disqualified you don’t pay the fee, because you didn’t get the service.

Even if you have had a criminal conviction (non-felony), it doesn’t mean you will automatically be denied.

The key is to be truthful in the application.

I knew someone who had a DUI that was pled down to careless driving, but she admitted it on the application (they said they could see it) and she was approved.

I also know someone who answered no, and they were denied because they had a misdemeanor conviction they didn’t know about 30 years prior (when he was in college).

He had pled “continuance for dismissal” and was told it would be off his record in a year.

Turned out it was entered as a guilty plea.

He pulled his record from the county he was convicted at to see, he had no idea.

He appealed his application saying he only found out 30 years after the fact and they approved his application in the end.

They charge the $100 up front and you are not refunded if you are denied.
